Box 936; Steamboat Springs, Colorado 80477 <br />~OM: Brad Janes, Reclamation Specialist RE: Our file X182-36 <br />c, <br />Pursuant to the requirement of the Colorado Mined Reclamation Actk <br />to inform counties and certain municipalities of Development and Extraction <br />(i.e. miningl Permit applications filed with this office, please know that <br />Peabody Coal Company has filed an <br />application for a Permit to mine sand and gravel <br />at the following legal description: X1'4, SW%,; Sec. 17; and N''-f, SEA; <br />SSdZ, SE't; Sec. 18; T6N; R87W; 6th P.tf. <br />The applicant proposes to reclaim the site for agriculture .The <br />deadline for .persons to file statements regarding this operation, or to <br />petition for a hearing before the Mined Land Reclamation Board to consider <br />the granting of a Permit is set by Zaw; for information please call this <br />office. <br />Prior to Board approval the applicant's prooosed mining and reclamation <br />plans must be in conformance with Local zoning ordinances, subdivision <br />regulations, or master plan. Pursuant to Sections 34-32-109(6) and <br />34-32-IIS(e) of the Colorado Mined Land Reclamation Act, C.R.S. 39-32-ZOI <br />et sue., please inform the Mined Land Reclamation Division as to the status <br />of the above captioned site with regard to conformance with your local <br />zoning laws. The attached sheet is provided so that you might answer us in <br />a convenient, quick manner. <br />If we do not hear from you before May 26-27, 1982 we will assume <br />that the above mining operation is in conformance with local zoning and Land <br />use. <br />Also, the applicant is required to place a copy of the application for public <br />inspection with the Clerk of the county in which the proposed mine is situated. <br />It is the Board's understanding that the Act intends for the application to <br />be made available for public review and comment in an area close to the mine; <br />it is not intended that it be made a part of public record by recording. <br />The Board is tentatively scheduled to consider this application on <br />26-27, 1982 <br />foe appreciate your cooperation in this matter and will be happy to answer any <br />questions. <br />*Article 32 of Title 39, Colorado Revised Statutes 1973, as amended. <br />Rev. 2/20 <br />423 Centennial Building. 1313 Sherman Street Denver.
