Cattany <br />1590 W. 12 Avenue Atting Division Director <br />Denver, CO 80204-3410 <br />RE: Revised Decision Date for River Valley Resources -Regular 112 Application <br />File No. M-2001-090, Class: Permit <br />Deaz Mr. Tuttle: <br />The Division has approved your request to extend the decision date on your Regular 112 Application for the <br />River Valley Resources site to September 12, 2002. Please note that this will be the final extension, per rule <br />1.4.1(9), since the date of filing for the River Valley Resources application was September 12, 2001. The lease <br />agreement and applicanUname issues discussed today between your attorney (M. L. Tucker) and Cheryl Linden of <br />the Attorney General's Office will need to be resolved on or before September 12, 2002. You will need to <br />Submit a revision to the application on or before September 11, 2002 to accommodate these changes. If these <br />issues aze not resolved to the Division's satisfaction by September 12, 2002, we have the option to either deny the <br />application or schedule this matter for a Boazd Hearing at the October 16-17, 2002 Meeting. At the hearing, the <br />Boazd may deny, or approve the applicafion with or without condifions. As an alternative to these options, you <br />may elect to withdraw your application and resubmit at a later date. <br />The lease agreement and applicant/name issues concern the link between the applicant originally specified <br />(Western Mobile Northern, Inc.) and the company we aze now corresponding with (Lafarge West, Inc.). It is our <br />understanding that Western Mobile Northern, Inc. is no longer in existence. Prior to a Division approval of your <br />application, you will need to cleazly demonstrate the following: 1) Lafazge West, Inc. is the applicant, 2) Gary <br />Tuttle is the permitting contact for Lafazge West, Inc., and 3) Lafazge West, Inc. has the legal right to enter the <br />More Family Ranches, LLC property for purposes of mining and reclamation. Items 1 and 2 can be submitted as <br />revised application pages. A copy of your lease agreement has been received, although the lease agreement <br />specifies Western Mobile Northern, Inc. rather than Lafarge West, Inc.
