• PROTECTION OF HYDROLOGICAL BALANCE - RULE 2.05.6(3) <br />The Bear Coal Company does not believe that any hydrologic consequences <br />will result as part of the mining activities. A detailed drainage and <br />sediment control program has been initiated to control all drainage from <br />the affected area. An NPDES permit has been approved and all surface <br />water discharge must meet the effluent limitations of that permit. <br />The underground mining is not anticipated to affect any groundwater. As <br />mentioned earlier, no water has been encountered in the Bear No. 2 and <br />likewise the old workings of the Clark mine. <br />The surface facilities of the Bear Coal Company should not pose any <br />problem for contamination of surface water or water found in the <br />alluvial material. <br />A comprehensive alluvial (groundwater) monitoring program has been <br />• initiated. Three shallow groundwater wells have been established and <br />will be monitored on a continuing basis throughout the mining operations <br />to determine any potential impacts on that groundwater. <br />Following mining activities, the area will be graded, re-topsoiled and <br />reseeded in accordance with the approved Reclamation Plan. Post-mining <br />cover and productivity will be achieved to the satisfaction of the <br />Division prior to any bond release. The sedimentation pond will remain <br />until such time that runoff from the reclaimed area will meet the <br />effluent limitations as established by the Division. <br />Because of the planned depth of the mining, subsidence should be minimal <br />and perhaps non-existent. An ongoing monitoring program for subsidence <br />will be maintained throughout the life of the operation. No surface <br />water degredation should occur even if minor subsidence does occur. <br />• The Bear Coal Company will not continue its efforts to permit a coal <br />conveyor system passing over the North Fork of the Gunnison River. <br />Therefore, no concerns will arise from this potential system.
