Colorado 81434 <br />February 17, 1982 <br />r~ <br />U <br />Mr. Dan Mathews <br />Reclamation Specialist <br />Colorado Mined Land Reclamation Division <br />423 Centennial Building <br />1313 Sherman Street <br />Denver, Colorado 80203 <br />Re: Adequacy Response - Bear No. 1 and No. 2 Mine; Bear No. 3 Revision <br />i <br />Dear Dan: <br />Pursuant to your letter of January 18, 1982 Concerning the Bear Coal <br />Company permit applications for the Sear No. 1, 2 and 3 operations, we <br />have included responses in this letter which will address your <br />comments and will clarify your additional concerns regarding the <br />planned mining operation. The information contained herein is to be <br />integrated into and considered a part of the permit applications. <br />The Bear Coal Company is currently working with ARCO Coal Company to <br />resolve their concerns about our mining plans. An agreement bet~~~een <br />the two companies regarding the legal rights-of-way at the Bear No. 3 <br />Operation will hopefully be forthcoming shortly. The legal <br />description of the area to be used for the Bear No. 3 surface <br />facilities may be slightly revised to include some additional area <br />(approximately 10 acres) as a result of the potential agreement with <br />ARCO; the revised legal description will be submitted to the Colorado <br />14ined Land Reclamation Division ("Division") under separate cover in <br />the near future. This additional area will not change any of the <br />mining or environmental control plans. <br />We must again emphasize that Bear Coal Company is facing a real <br />emergency. The immediate need for approval of mining plans at the <br />Bear No. 3 Operation and reclamation plans for the Bear No. 1 and 2 <br />Mines is imperative if we are to maintain present levels of production <br />and employment. Unlike many major coal producers, the Bear Coal <br />Company does not have vast amounts of coal reserves or large amounts <br />of financial backing. <br />• <br />
