Manning <br />Plant Ecologist <br />The Pittsburg & Midway Coal <br />Mining Company <br />1720 South Bellaire <br />Denver, CO 80222 <br />Dear Mr. Manning: <br />This office fias received and reviewed the Oak Creek .Expansion: <br />Cultural Resources Inventory for Pittsburg & Midway Coal Mining <br />Company. <br />There are several points that we feel need to be clarified and <br />corrected in order for this office to adequately assess the impacts <br />• to cultural resources and to aid in our review of the report. <br />1. This report has not,been paginated, and future reports <br />should be to expedite our review process. <br />2, In the first paragrapfi, under Site Evaluation, Determina- <br />tions of Eligibility and Effect and Piitigation Recommendation, the <br />term "National Park Service" is incorrect. Properties that may possess <br />any historical, architectural, archaeological, or cultural value are <br />to be evaluated by the federal Agency Official in consultation with <br />the State Historic Preservation Officer. .The final determination of <br />eligibility is then made by the Secretary of the Interior at the re- <br />quest of the Agency Official (36 CFR 800.4). <br />3. The report should include an overall description of the <br />types of impacts (such as construction activities, increased vehicu'_ar <br />traffic, etc.) that will occur within the area of the undertaking. <br />4. Please define the areas of direct and indirect impacts. It <br />is not necessary to make determinations of effect for properties which <br />are not eligible for inclusion in the National Register of Historic <br />Places. In addition, determinations of effect are not required for <br />properties deterained to be outside the impact area of the proposed <br />undertaking.
