Dear Mr. Gesso:
In response to your recent inquiries regarding how the Division of Minerals and Geology (Division) interprets mle
1.4.1(9) we have reviewed Rule 1.4.1(9) and have discussed this issue with Steve Brown of the Attorney General's
Office. Our interpretation of Rule 1.4.1(9) and how it applies to the MMRR Quarry 112 Applicaton is as follows:
the Division has the discrefion to extend the 365 day timeframe and schedule a Formal Public Hearing before the
Colorado Mine Land Reclamation Boazd after the 365'" day from date of filing (November 9, 2004) so long as the
Applicant (Clear Creek District Water Providers, LLC) is diligent in resolving outstanding adequacy concerns. As
you may know, our current action dates areas follows:
• 08/19/05 Preferred date for receipt of adequacy response to DMG's god adequacy letter.
• 09/16/05 DMG recommendation date, rationale document to follow prior to pre-Hearing Conference.
• 09/27/05 pre-Heazing Conference beginning @ 9:00 A.M., Room 318, 1313 Sherman Street, Denver
• 10/12/05 - 10/13/05, Formal Public Hearing, Room 318, 1313 ShetTnan Street, Denver, Colorado
In the event it is not feasible for you to adequately resolve the Division's outstanding adequacy concerns under the
action dates listed above, you may submit a written waiver of your right to a decision and Boazd Hearing under the
current time schedule and request that the dates listed above be revised. Under that scenario, please provide your
written waiver on or before September 16, 2005, and please advise us as to the length of time needed to prepaze an
adequate response to resolve the Division's adequacy concerns.
