<br />Letter to Robert Flemino 4 December 7. 1994 <br />informing them that the proposed mining set-back is 25 ft., not 50 ft., <br />and also notifying them of how their concerns will be mitigated under <br />the terms of the Reclamation Permit for the proposed operation, as well <br />as other required permits. if the Brody's are not satisfied with this <br />resolution, the application would have to be scheduled for a hearing <br />before the Mined Land Reclamation Board. In order to avoid that <br />eventuality, the applicant may wish to enter into a compensation <br />agreement with the Brody's, and submit the agreement for inclusion in <br />the Reclamation Permit. This would fit the resolution that the Brody's <br />are requesting in the final paragraph of their letter. <br />Please submit proof of newspaper publication and surrounding landowner <br />notification as they become available.
