Box 130 <br />San Luis, CO 81152 <br /> <br />Re: Discrepancies in the deed description & Div. of Minerals & Geology gravel permit application <br />Deaz Mr. Valdez: <br />I have reviewed the information that you provided concerning Costilla County's pending permit application <br />and the boundary survey of said property as per Luchetti Land Surveying. The enclosed sketch shows the <br />location of the two descriptions based entirel on their math. Mr. Luchetti is a Colorado licensed land <br />surveyor who was retained by the County to survey the property as per the Quit Claim Deed. During the <br />course of his survey, he recovered three pins set by PE-LS No. 13389 (Kurt Booe), one of the pins being the <br />northwest corner of the gravel pit pazcel and another being the SE corner of Book 153 Page 155 as <br />referenced in the deed. <br />Both surveyor's appeaz to agree with each other and it seems that the distance for the tie given in the Quit <br />Claim deed is in error and has been corrected on the Luchetti plat. The Quit Claim Deed does reference that <br />the west line of the gravel pit pact is the east right-of--way line of the existing road, which is in agreement <br />with the Luchetti plat. An examination of the information I have does not reveal if the current road right-of- <br />way is the same as the road right-of--way referenced in the 1959 deed but it must be assumed from Mr. <br />Luchetti's work that they aze the same. The reference in the Quit Claim deed to a tract containing ] 0.8 acres _ <br />is in erro~thesroperty_described in said deecLenl~encompasses_8.08 acres, which strongly supports Mr. <br />Luchetti's acreage of 8.04 acres. <br />Surveying within Costilla County is a challenge, with problems in descriptions being the noun rather than a <br />rarity. An office examination of the Luchetti survey of the deed location does not disclose abnormal errors; <br />the County's application is based on, and appears to be in agreement with, said survey, and h_e bearina_ <br />differences appear to be the result of Mr Luchetti using a different basis of bearing than was used in the uit <br />Claim Deed. <br />131411'" Street - P.O.
