sss~ ~~
The Division of Minerals and Geology
1313 Sherman Street, Room 215
Denver, Colorado 80203
c~ b~~~.~;,-, ~1r
December 22, 2005
-sa ~ ci
j:
!', : 2 2C~a
This letter is written with the intent to express my concerns and
request that the Benson Brothers Red Shale Mining Pit Permit in
Delta County be denied until such time that they fully comply
with the permit requirements.
I live adjacent to the Bensons property on the south and directly
below the Rollins Cliffs. My property addresses are 20993 and
2099'7 Snowdrift Road. I also own, manage & work the 2.5
acre vineyard south of and adjacent to the Benson property.
After careful review and study of the Benson's permit
application form and the attachments, I find several areas where
the information provided by the Bensons is incomplete,
misleading and false.
From the very get-go, the brief description of the existing land
use & general character of the land within one half mile of the
outside boundries of the subject property is misleading and
false. The pernut indicates that the surrounding land is pinion,
juniper, sage rangeland with some pasture land in flatter areas to
the south and west where there are some small ranches.
Actually this is a very rapidly growing residential community in
all directions from the Benson's property.
Please reference the attached pictures taken from the top of the
Rollins Cliffs. There are 3 properties adjacent to and directly
under the south boarder of the Bensons property with many
surrounding residences. In order to fiuther emphasize the
residential community to the south, I have identified all
buildings and their square footage on the attached map. I have
also identified the 2.5 acre commercial vineyard that has not
been recognized in the permit application.
