• and DMG terminated the NOV with an understanding that the requirement to maintain and collect data <br />from crest stage gages and single stage sampler be deleted from the permit. <br />NOV C-98-007 was issued on August 6, 1998 for "failure to maintain certain culverts at the East Portal <br />Area and East Portal Access Road as necessary to safely pass the peak runoff from a 10-year, 24- <br />hourstorm event BME contested this NOV. It was eventually vacated by DMG. <br />2.03.6 Right of Entry and Operation Information <br />Docurfents upon which Blue Mountain Energy, Inc. bases its legal right to enter and begin mining <br />activities in the permit area are included as Exhibit 1-1 through 1-3 at the end of this section. There is <br />no pending litigation regarding either surface or mineral ownership. <br />2.03.7 Relationship to Areas Designated Unsuitable for Mining <br />2.03.7(1) Unsuitable Designation Status. An environmental impact assessment prepared by Bureau of <br />Land Management (BLM) stated that the twenty criteria contained in 40CFR3460, published in the Federal <br />Register July 19, 1979, would be addressed by OSM and CMLRD (now DMG) in the Technical <br />Environmental Assessment. OSM or CMLRD did not designate any area unsuitable for mining within the <br />permit area. <br />• 2.03.7(2) Not Applicable <br />2.03.7(3) Not Applicable <br />2.03.8 Permit Tenn Information <br />The starting date for the construction activities to begin development of the mine was July, 1981. Coal <br />shipment began in the first quarter of 1984. The mine has enough coal reserves to last for about 20 <br />years at the current rate of mining.
