NW Y. of Section 3, Township 15 South, Range 95 West of the 61° Principal <br />Meridian, Delta County. Cotorado. <br />WHEREAS, the Planning Departmwtnofified all smmundiag property owners within a ],000 <br />feet of the subject properly and appropriate review agweies by mail; and placed public <br />notice in the Delta County Tndependwt az least sevwtew days prior to the scheduled <br />Delta Area Planning Committee. <br />WI~REAS, numerous comments were received fimm property owners within 1,000 feet of the <br />proposed site. <br />WI~REAS, the Delta Area Planning Committer reviewed this applicaROn az their regular <br />meeting on September 8, 2004. After considerable discussion the proposal was <br />tewmmended for approval with the inclusion of the staff recommwdatioas. <br />WHEREAS, the Delta County Planning Commission reviewed this application az its regular <br />meeting on September 23, 2004. A motion was passed to approve the application with <br />staffrecammwdations. <br />NOW THEREFORE, BE TT RESOLVED, by the Board of County C®aissioners of Delta <br />County thaz Specific Developmwt SD04-009 Benson Brothers Grovel Pit shall be and <br />hereby is approved subject to the conditions set forth in the development agreemwt; <br />attached hero and by uperwce made a part hereof with conditions and: <br />BETT FURTHER I2ESOLVID, a Development Agreement will be signed by the applicant and <br />the Board ofCounty Commissioners with approved conditions. <br />BE TT FURTFIIR RESOLVID, Any violation of the conditions in the Developmem Agreemwt <br />may tae grounds for the revocation of the Development Agreement approved by the <br />County.
