Box 1846
Buena Vista, Colorado 81211
Re: Pridemore Construction, Inc. - "JESSE LEE OPERATION"
File No. M-84-043
Dear Mr. Wright:
I have received your reply to my adequacy letter of May 10, 1984, There are
still several areas of concern that I feel have not been adequately replied to
by your responses. I will use the same Exhibit letter and question number
designations as in my original adequacy letter. Any questions not mentioned
again are considered adequately answered now. Please respond to this letter
by no later than June 22, 1984. In this way, I can review your responses and
comment, as necessary. This will allow the application to be ready for Board
consideration during the scheduled June 27-28, 1984 meeting.
Please submit the proofs of mailing (certified mail white or green receipts,
J or copies thereof) of notifications to the landowner of the permit area and
all immediately adjacent landowners (if any). These proofs must be received
before the Board can consider the permit application.
Exhibit R
6. The probable depth of water in the pit during the mining operation is
not clear. If water is exposed in the pit to some depth, dewatering of
the pit (requiring an NPDES permit form the Colorado Department of
Health) or wet mining methods (such as a dragline) may be needed.
Please clarify this matter further.
9. The use of aggregate material in excess of 1 1/2 inches in size for
J backfilling and/or slope protection is still not clear. Will this
material be sufficient in volume to backfill a great portion of the pit
area? How much of the pit will be backfilled in this manner? Please
clarify this matter further.
Exhibit E
Your comments concerning the reclamation plan make it clear that you are
attempting to resolve a conflict with the landowner of the permit area.
Unfortunately, your proposed compromise conflicts with the performance
standards of our law. If Mr. Champion does not wish to allow the permit area
to be reclaimed to a benefical land use, then it may be that the area cannot
423 Centennial Building, 1313 Sherman Street Denver, Colorado 80203 Tel.
