Box 1846 <br />Buena Vista, Colorado 81211 <br />Re: Pridemore Construction, Inc. - "JESSE LEE OPERATION" <br />File No. M-84-043 <br />Dear Mr. Wright: <br />I have received your reply to my adequacy letter of May 10, 1984, There are <br />still several areas of concern that I feel have not been adequately replied to <br />by your responses. I will use the same Exhibit letter and question number <br />designations as in my original adequacy letter. Any questions not mentioned <br />again are considered adequately answered now. Please respond to this letter <br />by no later than June 22, 1984. In this way, I can review your responses and <br />comment, as necessary. This will allow the application to be ready for Board <br />consideration during the scheduled June 27-28, 1984 meeting. <br />Please submit the proofs of mailing (certified mail white or green receipts, <br />J or copies thereof) of notifications to the landowner of the permit area and <br />all immediately adjacent landowners (if any). These proofs must be received <br />before the Board can consider the permit application. <br />Exhibit R <br />6. The probable depth of water in the pit during the mining operation is <br />not clear. If water is exposed in the pit to some depth, dewatering of <br />the pit (requiring an NPDES permit form the Colorado Department of <br />Health) or wet mining methods (such as a dragline) may be needed. <br />Please clarify this matter further. <br />9. The use of aggregate material in excess of 1 1/2 inches in size for <br />J backfilling and/or slope protection is still not clear. Will this <br />material be sufficient in volume to backfill a great portion of the pit <br />area? How much of the pit will be backfilled in this manner? Please <br />clarify this matter further. <br />Exhibit E <br />Your comments concerning the reclamation plan make it clear that you are <br />attempting to resolve a conflict with the landowner of the permit area. <br />Unfortunately, your proposed compromise conflicts with the performance <br />standards of our law.
