M-77-378
Dear Mr. Perino:
The Division has received your August 13, 1996 request for an extension
to the initial 5 year period of temporary cessation status granted by
the Division on August 17, 1991. However, since fina><1 reclamation
activities began at the site since the date the operation was placed in
temporary cessation, the operation was effectively removed from
temporary cessation status at that time. Please refer to the wording
of Rule 1.13.3 (1), Indications Against Temporary Cessation, which
states that "Extraction of minerals has been completed and only final
reclamation and related activities occurring at the site are part of
the life of the mine". Therefore, a request for a second period of
temporary cessation is not necessary in this instance.
Since the operation is in final reclamation, the requirements of Rule
3.1.3, "Time Limit and Phased Reclamation", come into e:Efect. If your
August 13, 1996 letter represents the first instance in which Sunnyside
Gold Corp. has informed the Division that the first phase of final
reclamation has commenced, then the operator has five }ears from that
date to complete reclamation within that first phase, >mless extended
by the Board or Office. The Division recommends that you provide some
clarification to the timing of the various reclamation phases underway
at the mine by updating any previous time schedules set forth for final
reclamation activities.
Please contact me at the Durango Field Office at our new address, 484
Turner Drive, Building F, Suite 101, Durango, Colorado 81301,
telephone no. (970) 247-5193 if you have any questions.
Sincerely,
~/
Tom Gillis
Senior Environmental
/tdg
a:m378tcex.tdg
Protection Specialist
