PART 1 Page No. 3 Permit No. COG-850000 COVERAGE UNDER THIS PERMIT s general permit authorizes discharges that consist entirely or principally of precipitation-induced surface runoff from acid ar erruginous coal mining and processing operations including loadouts, while active mining is occurring or during reclamation prior to final bond release, to land (as dust control), and into waters of the State of Colorado. If additional sources which the Division determines to be minor in nature such as selected mine water, preparation plant water, spoils spring water, runoff through refuse piles, or other wastewater may be discharged. These sources may be covered under this permit at the Division's discrerion, providing that such wastewater would no[ require effluent limitations and/or monitoring requuements other than those contained in this permit. Such detemrinations will be made on acase-by case basis upon review of the pernilt application and any additional relevant information. This permit does not cover underground mining. ]f discharge from one or more of the above listed sources require additional limitations and/or monitoring requirements, an individual permit maybe required. Multiple dischazge points from one facility maybe authorized through this permit providing all meet these criteria. 2. ]n order to apply for certification under this general permit, the owner, operator, and/or authorized agent of the subject facility shall submit by certified mail or hand delivery, the completed Coal Mining Wastewater Discharge Application (famished by the Division) which generally requires the following information (at a minimum): a. Name, address, and descriptive location of the facility; b. Name of principal in charge of operation of the facility; c. l~'ame of immediate receiving waters, (including imgation ditches, intermittent streams and dry drainage, as applicable); d. Description of the type of activity(ies) resulting in the discharge, including the anticipated duration of the activity and/or the discharge, anticipated volume and rate of dischazge, and the source(s) of water to be discharged; e. Description of any wastewater treatment system(s) and recycle/reuse utilized; f. An 8 %x 11 inch map showing the genera] geographical location ofthe facility and any nearby landfills, mine or mill tailings, or any other known or suspected sources of pollutants; g. An 8 '/, x 11 inch sketch of the facility showing all structures, outfalls and receiving waters, as well as storage locations of any petroleum or chemicals on site; and b. A chemical analysis of the water to be discharged. If no water is available, this shall be indicated. '• If the discharge is to a storm sewer system, ditch, or other manmade conveyance, approval from the owner ofthe system must be obtained before discharge. At least 30 days before the anticipated date of discharge, such information shall be submitted on the application form to: Colorado Deparunent of Public Health and Environment Water Quality Contra] Division WQCD-P-B2 4300 Cherry Creek Drive South Denver, CO 80222-1530 The Division shall have up to thirty days after receipt of the above information to request additional data or deny lire authorization to discharge. Upon receipt of additional information, the Division shall have an additional 30 days to issue or deny authorization to discharge. ]f the applicant does not receive a request for additional information or a notification of denial from the Division within thirty days, authorization to discharge in accordance with the terms and conditions of the permit shall be deemed granted. If the Division determines that a new facility does nol fall under the authority ofthe general permit, then the information received will be processed for an individual permit and discharge will not be allowed until 180 days after the date the application was received. The applicant shall be notified of such a detemrination. ]f during the renewal process, the Division determines that a facility no longer qualifies far the genera] permit, the facility will be allowed to discharge under the general permit until an individual permit is issued. 3. Authorization to discharge under this general permit shall expire on lone 30.2007. The Division must evaluate this general permit once every five yeazs and must recertify all applicants' authority to dischazge under the general permit at such time. Therefore, a permittee desiring continued coverage under the general permit must reapply by ]anuarv ], 2007. The Division will determine if the applicant continues to operate under terms of the general permit.
