PART 1 <br />Page No. 3 <br />Permit No. COG-850000 <br />COVERAGE UNDER THIS PERMIT <br />s general permit authorizes discharges that consist entirely or principally of precipitation-induced surface runoff from acid ar <br />erruginous coal mining and processing operations including loadouts, while active mining is occurring or during reclamation prior to <br />final bond release, to land (as dust control), and into waters of the State of Colorado. If additional sources which the Division determines <br />to be minor in nature such as selected mine water, preparation plant water, spoils spring water, runoff through refuse piles, or other <br />wastewater may be discharged. These sources may be covered under this permit at the Division's discrerion, providing that such <br />wastewater would no[ require effluent limitations and/or monitoring requuements other than those contained in this permit. Such <br />detemrinations will be made on acase-by case basis upon review of the pernilt application and any additional relevant information. This <br />permit does not cover underground mining. ]f discharge from one or more of the above listed sources require additional limitations <br />and/or monitoring requirements, an individual permit maybe required. Multiple dischazge points from one facility maybe authorized <br />through this permit providing all meet these criteria. <br />2. ]n order to apply for certification under this general permit, the owner, operator, and/or authorized agent of the subject facility shall <br />submit by certified mail or hand delivery, the completed Coal Mining Wastewater Discharge Application (famished by the Division) <br />which generally requires the following information (at a minimum): <br />a. Name, address, and descriptive location of the facility; <br />b. Name of principal in charge of operation of the facility; <br />c. l~'ame of immediate receiving waters, (including imgation ditches, intermittent streams and dry drainage, as applicable); <br />d. Description of the type of activity(ies) resulting in the discharge, including the anticipated duration of the activity and/or the <br />discharge, anticipated volume and rate of dischazge, and the source(s) of water to be discharged; <br />e. Description of any wastewater treatment system(s) and recycle/reuse utilized; <br />f. An 8 %x 11 inch map showing the genera] geographical location ofthe facility and any nearby landfills, mine or mill tailings, or any <br />other known or suspected sources of pollutants; <br />g. An 8 '/, x 11 inch sketch of the facility showing all structures, outfalls and receiving waters, as well as storage locations of any <br />petroleum or chemicals on site; and <br />b. A chemical analysis of the water to be discharged. If no water is available, this shall be indicated. <br />'• If the discharge is to a storm sewer system, ditch, or other manmade conveyance, approval from the owner ofthe system must be obtained <br />before discharge. <br />At least 30 days before the anticipated date of discharge, such information shall be submitted on the application form to: <br />Colorado Deparunent of Public Health and Environment <br />Water Quality Contra] Division <br />WQCD-P-B2 <br />4300 Cherry Creek Drive South <br />Denver, CO 80222-1530 <br />The Division shall have up to thirty days after receipt of the above information to request additional data or deny lire authorization to <br />discharge. Upon receipt of additional information, the Division shall have an additional 30 days to issue or deny authorization to <br />discharge. ]f the applicant does not receive a request for additional information or a notification of denial from the Division within thirty <br />days, authorization to discharge in accordance with the terms and conditions of the permit shall be deemed granted. <br />If the Division determines that a new facility does nol fall under the authority ofthe general permit, then the information received will be <br />processed for an individual permit and discharge will not be allowed until 180 days after the date the application was received. The <br />applicant shall be notified of such a detemrination. ]f during the renewal process, the Division determines that a facility no longer <br />qualifies far the genera] permit, the facility will be allowed to discharge under the general permit until an individual permit is issued. <br />3. Authorization to discharge under this general permit shall expire on lone 30.2007. The Division must evaluate this general permit once <br />every five yeazs and must recertify all applicants' authority to dischazge under the general permit at such time. Therefore, a permittee <br />desiring continued coverage under the general permit must reapply by ]anuarv ], 2007. The Division will determine if the applicant <br />continues to operate under terms of the general permit. <br />
