Requirements of Section 6.16.0 of the Regulations for the State Discharge Permit System have been met, and <br />iv. Requirements of public notice have been met. <br />d. Permit modification (excep[ for minor modifications), termination or revocation and reissuance actions shall be , <br />subject to the requirements of Sections 6.6.2, 6.6.3, 6.7.0, 6.8.0 and 6.16.0 of the Regulations for the State <br />Dischazge Permit System. The Division shall act on a permit modification reques[, other than minor modifications <br />reauesu, within 180 days of receipt thereof. Except for minor modifications, the terms of the ezis[ing pcrmi[ <br />govern and are enforceable until the newly issued permit is formally modified or revoked and reissued following <br />public notice. <br />e. Upon consent by the perrnittee, the Division may make minor permit modifications without followin¢ the <br />requirements of Sections 6.6.2, 6.6.3, 6.8.0, and 6.16.0 of the Regulations for the State Dischazge Permit System. <br />Minor modifications to perrniu are limited to: <br />i. Correcting typoeraphical errors; or <br />ii. Increasing the frequency of monitoring or reponing by the perminee; or <br />iii. Changing an interim date in a schedule of compliance, provided the new date of compliance is not more than <br />120 days after the date specific in the existing permit and does not interfere with attainmen[ of the final <br />compliance dace requirement; or <br />iv. Allowing for a vansfer in ownership or operational control of a facility where the Division determines that no <br />other cbanse in the permit is necessary, provided that a written agreement containine a specific date for transfer <br />of permit responsibility, coverage and liability between the curreat and new perminees has been submiued to the <br />Division; or <br />v. Changing the cotuwction schedule for a discharge: which is a new source, but no such changt shall affect a <br />dischazger's obligation to hzve all pollution convol equipment installed and in opera[ion prior to dischazee; or <br />vi. Dele[ing a point source outfall when the discharee from that outfall is terminated and does not result in <br />discharee of pollutanu from other outfalls except in accordance with permi[ limits. <br />f. When a permit is modified, only the conditions subject to modification are reopened. If a permit is revoked and <br />reissued, the entire permit is reopened and subject to revision and the permit is reissued for a new term. <br />g. The filing of a request by the permittee for a permit modification, revocation and reissuance or termination does not <br />stay any permit condition. <br />h. A71 permit modifcations and reissuanca arc subject to the an[ibacksliding provisions set forth in 6.11.0 (5) through <br />(9)• <br />6. Oil and Aazardovs Substance Liabiliri <br />Nothing in this permit shall be construed to preclude the institution of any legal action or relieve the petmittee from any <br />responsibilities, liabilities, or penalties to which the perminee is or may be subject to under Section 311 (Oil and <br />Hazardous Substance Liability) of the Clean Water Act. <br />
