PART I <br />Page No. 3 <br />Permit No. COG-850000 <br />COVERAGE UNDER THIS PERMIT <br />This general permit authorizes discharges that consist entirely or principally of precipitation-induced surface runoff from <br />coal mining and processing operations including loadouts, while active mining is occurring or during reclamation prior to <br />fmal bond releaze, into waters of [he State of Colorado. If additional sources which [he Division determines [o be minor <br />in nature such as selected mine watez, preparation plant water, spoils spring water or other wastewater may be <br />discharged, these sources tray be wvered under this permit at the Division's discretion providing that such waztewater <br />would not requue effluent limitations and/or monitoring requuements other than those contained in this permit. Such <br />determinations will be made on a case-by case basis upon review of the permit application and any additional relevant <br />information. If discharge from one or more of the above listed sources require additional limitations and/or monitoring <br />requirements, an individual permit tray be required. Multiple discharge points from one facility tray be authorized <br />through this permit providing all meet these criteria. <br />2. In order to apply for cenific2tion under this general permit, the owner, operator, and/or authorized agent of the subject <br />facility shall submit by ceniired mail or hand delivery, the completed Coal Minins Wastewater Discharge Application <br />(furnished by the Division) which generally requires the following information (at a minimum): <br />a. Name, address, and ducriptive location of the facility; <br />b. Name of principal in charge of operation of the facility'; <br />c. Name of immediate receivins waters, (including irrigation ditches, intemtittea[ streams and dry drainase, az <br />applicable); <br />d. Description of the type of activiry(ies) resulting in the discharge, including [he anticipated dur[ion of the activity <br />and/or the discharge, anticipated volume and rate of discbarae, and the source(s) of water to be discharged; <br />e. Description of any wastewater treatment system(s) and recycle/reuse utilized; <br />f. A topographic 8° z 11 inch map showing the general geographical location of the facility and any nearby landfills. <br />mine or mill tailings, or any other known or suspected sources of pollutants: . <br />g. P.a 8~ z 11 inch skeuh of the facility showing all strucruru, outfalls and receiving waters, as well as storage <br />locations of any petroleum or chemicals on site; and <br />b. A chemical analysis of the water ro be discharged. If no water is available, this shall be indica[ed. <br />If the discharge is [o a storm sewer system, ditch or other manmade conveyance, approval from the owner of the system <br />must be obtained prior to discharge. <br />At ]east 30 days prior to the anticipated date of discharge, such information shall be submined on the application form <br />to: <br />Colorado Deparrment of Public Health and Endvorrment <br />W"QCD-PE-B2 <br />4300 Chem Creek Drive South <br />Denver; CO 80222-1530 <br />The Division shall have up to thirty days after receipt of [he above information to request additional data or deny the <br />authorization to discharge. Upon receipt of additional information, the Division shall have an additional 30-days to issue <br />or deny authorization to dischar_e. If the applicant does not re`eive a reovest for additional information or a notification <br />of denial from the Division within thirty days, authorization w discharge in accordance with the teens and conditions of <br />the permit shall be deemed granted. <br />If the Division determines [hat a new farliry does not fall under the authority of [he general permit, chew the information <br />received will be processed for an individual permit and discharge will not be allowed until 180 days aher the date the <br />application was received. The applicant shall be notified of such a determination. If during the renewal process, the <br />Division determines that a facility no longer qualifies for the general permit, the facility will be allowed to discharge <br />under the general permit until an individual permit is issued. <br />•3. Authorisation ro discharge under this general permit shall expire on June 30. 3002. The Division must evaluate this <br />"gene: al permit once every five years and mtsst also rerenify al] applicants' authority to discharge under the general <br />permit at such time. Therefore, a permittee desiring continued coverage under the general permit must reapply by <br />January 1. ?003. The Division wilt determine if the applicant continues to operare under terms of the general permit. <br />
