<br />THIS PER.*lIT is issued [his 13 day of November, 1978 by the Mined Land
<br />Reclamation Board, Department of Natural Resources, state of Colorado..
<br />W I T N E S S E T H
<br />WHEREpS,Richard Geiser[ desires to conduct a(n) open mining
<br />operation, known as D b F Enterprises Pit ~ for the purpose of extracting open
<br />mined sand 6 Gravel and
<br />WHEktEAS, on July 5 1978 Richard Geisert "FILED" an appli-
<br />cation, a reclamation plan and map, and the required fee, as required by law; and
<br />WHERE?S, onSeptember 27 , 1978 the Mined Land Reclamation Board approved
<br />Richard GEisert's application and sec bond; and
<br />WHERnAS, on November 13 , 19 ]$ , the Mined Land Reclamation Board accepted surety
<br />submitted by Richard Geisert and =uch date shall be considered the
<br />data of issuance of the permit and the anniversary date far all ocher purposes; and
<br />WHEREAS, the Mined Land Reclamation Board has made a finding, far the purposes
<br />of issuing this permit, that:
<br />1) the application cc~pLies with the requirements of toe Colorado
<br />~.ined Land Reclamation Act and all applicable local, state and
<br />Federal laws; and,
<br />2) [he operation will not adversely affect the stability of any
<br />significant, valuable, and permanent man-made structures located
<br />within two hundred feet of the affected land, except where there
<br />is an agreement berreen the operator and the persons havin` ar.
<br />incarest in the structure that damage to the structure is to be
<br />compensated for by the operator; and,
<br />3) the proposed mining operations and reclamation can be carried out
<br />in conformance with the requirements of C.R.S. 1973, 34-32-116,
<br />as amended (1976 Sess. Laws H.B. 1065); and
<br />WHEREAS, for the purposes of issuing this permit, the operator has made
<br />a satisfactory showing to the Board that he will employ during and after his
<br />open mining operations procedures reasonably designed to minimize
<br />u practicable the aisruption from the open mining operations and •.+!::
<br />provide far the rehabilitation of the affected land through the rehabilitation of
<br />cover, soil stab 111ty, water.resources, and ocher measures appropriate co the
<br />subsequent. beneficial use of such mined and reclaimed lands; and that in
<br />the event of the failure of his proposed reclamation plan, he will take whatever
<br />.ensures which may be necessary in order to assure the success of reclamation of
<br />the lands affected by his open mining operations; and,
<br />WHEREAS, for the purposes of issuing this permit, a copy bi the application
<br />approved by the `tined Land Reclamation Board of the State of Colorado Ss attached
<br />to this permit and thereby becomes apart of the [eras hereof.

<br />NOW, T1IEREFORE, pursuant to the authority set forth in the Colorado lined
<br />Land Reclamation Act, Article 32 of Title 34, C.R.S. 1973, as amended, (1976
<br />Sesr. Laws H.B. 1065) the "tined Land Reclamation Board of the State of Calotido
<br />hereby issues a life of the mine permit to Richard Geisert to engage in
<br />open mining Eor the purpose of extracting open
<br />mined sand 6 gravel „n the following parcel of ground, to wit:
<br />An 87.547 Acre tract contained in a portion of the NEi: SW~, the NWT SE} and the
<br />NE1 SEt, all of Section 31, Township 6 North, Range 65 West of the 6th P.N.,
<br />Weld County, State of Colorado
