Box 229 <br /> Boulder, Colorado 80306 <br /> RE: Deepe Farm Pit; Our file #81-302 <br /> Dear Mrs. Winter.: <br /> On April 22, 1982, the Mined Land Reclamation Board approved the above <br /> application. Upon receipt of the $61,000.00 bond the Division will <br /> issue your permit (please refer to insert) . <br /> The Division conditioned its approval with two stipulations: <br /> 1. If plans to relocate Irrigation Ditch #2 are not approved by the ditch <br /> company having an interest in the structure, then Flatirnn Sand and Gravel <br /> Company should submit a technical revision which describes how the ditch <br /> will be protected from mining activi�:ies at the site; and , include a <br /> statement, in conformance with Rule 1.56(5) of the Rules and Regulations, <br /> that an agreement exists between the operator and the ditch company that <br /> damage to the structure will be compensated for by the operator. <br /> 2. The attention of the operator is directed to the necessity of compliance <br /> with Colorado Water Law. The Division of Water Resources has made <br /> recommendations (see enclosure) conca.rning the permit operation. The <br /> operator is encouraged to resolve anv differences regarding such recommendations <br /> with the Division of Water Resources . If the operator chooses to commence <br /> operations prior to resolution of an.: differences, the Sinte Engineer may <br /> take enforcement action under state water law. <br />
