Shiely <br />Dear Mr. Shiely: <br />ADMINISTRATIVE DIVISION <br />Please be advised that the Planning Department Staff letter <br />dated 6 February 1980 from Mr. Ken Strohaon that was mailed to <br />Mr. Gilbert F. Rindahl regarding Ready Mix Concrete Company and a <br />request "to move their crushing operation from its present <br />location to 'Parcel 6,' as shown on the drawings on file" in our <br />office was in error; therefore, Ready Mix Concrete Company is <br />directed to cease and desist all mining and/or accessory uses on <br />said Parcel 6. Additional investigation regarding the subject <br />case indicates that the subject Parcel is zoned A-3 with a <br />Mineral Conservation (M.C.) Overlay. The requirements for that <br />Overlay are explained in the 1980 Adams County Zoning <br />Regulations: "... the extraction of commercial mineral deposits <br />with necessary accessory uses shall be allowed in all zone <br />districts as a conditional uee upon approval and in conformance <br />with an approved excavation and rehabilitation plan" (Section <br />11.330). <br />According to Planning Department records, Ready Mix Concrete <br />Company is not in conformance with the existing County <br />Regulations and operations on Parcel 6 are required to stop <br />immediately. Review of the "Application for Mining and <br />Reclamation Permit - Adams Aggregate, Inc.: Adams County, <br />Colorado, September 1977" on file with, and approved by, the <br />Colorado Mined Land Reclamation Board also indicates that Parcel <br />6 is not included; therefore, "Local Government Approval" for <br />said Parcel is deficient. Representatives from Ready Mix <br />Concrete Company should have been aware of that application and <br />the exclusion of Parcel 6. Mr. David Shelton of the Colorado <br />Mined Land Reclamation Board concurrently is being notified of <br />this revelation. <br />! Mining and/or accessory uses on Parcel 6 under the Mineral <br />
