Mine, File C-81-037 <br />Dear Dr. Corley: <br />The Division has completed its research on the drill hole referenced in your <br />letter of April 25, 1992. Mr. Glenn Miller, a consulting geologist in Fremont <br />County, reviewed for us certain drill hole logs in his possession. According <br />to Mr. Miller, Sheridan Enterprises performed exploration drilling at the <br />Newlin Creek Mine in 1978. Sheridan Enterprises in 1978 had an option to <br />purchase the Newlin Creek Mine from Newlin Creek Coal Company. After <br />completing the drilling, the company apparently chose to not exercise their <br />option. Mr. Joseph Carpine, an owner of the Newlin Creek Coal Corporation, <br />corroborated this information during a phone conversation on May 15, 1992. <br />Sheridan Enterprises identified its exploration drill holes with the <br />abbreviation NC. The locations of these sites are identified on maps located <br />in Section 2.04.6 of the Newlin Creek Mine permit application. The drill hole <br />you have referenced, located west of the West Pit, is identified as NC-7 and <br />is shown by the maps to fall within the Newlin Creek Mine permit area. <br />Your letter of April 25th indicated that Mr. David Neslin, attorney for <br />Harrison-Western, had testified before the Minea Land Reclamation Board that <br />Harrison-Western had drilled hole NC-7. I listened to the tapes from both the <br />March 1992 and April 1992 Board meetings. During the March 1992 Board <br />meeting, Mr. Neslin indicated that Harrison-Western had reviewed their files <br />and were unable to find any aocumentation that they had drilled the hole, but <br />that did not completely rule out the possibility that they had done so. <br />During the April 1992 Board hearing, Mr. Neslin showed a transparency of the <br />West Pit and pointed out the location of the drill hole. He did not testify <br />that Harrison-Western drilled the hole. <br />The Division finds that Harrison-Western was not responsible for coal <br />exploration at the drill site west of the West Pit known as NC-7. Therefore, <br />the Division will not proceed with enforcement actions against Harrison- <br />Western on this issue. We are tontinuing our investigation regarding the <br />
