Memo to (dike Lonq - 3 - March 7, 1989 <br />Gnlden Eagle Mine C-81-013 <br />From January 1988 to April 1988 three violations were issued at the Gnlden <br />Eagle Mine. All three violations have been through the assessment and hearing <br />process. The violations were all abated and penalties paid. The following <br />list is a short summary of the violations followed by consideration of <br />circumstances suggesting that a Pattern of Violations may exist. There were <br />two cessation orders and one Notice of Violation issued to the Golden Eagle <br />Mine between January and April, 1988. <br />C-88-003 was a Cessation Order issued on January 22, 1988 and written for <br />failure to obtain a valid Permit for the area where surface coal operations <br />were being conducted and failure to obtain final aDOroval before being <br />implementing a revision to a permit. Specifically, the operator's underground <br />working had extended beyond the approved permit boundary which at the time was <br />under consideration for expansion via a technical revision. <br />Abated - 2/4/88 (Via TR-5) <br />Final Assessment - $3,500.00, Paid <br />C-88-017 was a Cessation Order issued on Aprii 6, 1988 and written for failure <br />to adhere to the conditions of the permit thus violating the permit and <br />causing or being reasonably expected to cause significant environmental harm <br />to land, air, or water resources. Failure to maintain a support facility to <br />prevent damage to fish, wildlife, and related environmental values. Failure <br />to conduct surface coal mining operations to minimize disturbances and adverse <br />impacts of the operations on fish, wildlife, and related environmental <br />values. Specifically, a fl occulent not described in the permit application <br />nor approved in the permit was used by the operator as part of the treatment <br />of mine water prior to its discharge into the natural surface water drainage <br />system. This flocculent which was added to the mine water at the treatment <br />facility, was then directly discharged in company with the mine water in <br />quantities lethal to aquatic life resident in that natural surface water <br />drainage system. <br />Final Abatement - 10/4/88 <br />Final Assessment - $11,000.00, Paid <br />C-88-019 was a Notice of Violation issued on April 6, 1988 and written for <br />failure to provide professional certification of the construction of an <br />impoundment embankment immediately after construction of the embankment, <br />failure to provide plans for reconstruction or modification of an impoundment, <br />and failure to secure Division approval before modification of an impoundment <br />begins. Specifically, Pond 002 which had previously been rendered inoperable <br />and taken out of service by the operator, had critical embankment <br />reconstruction performed on it and was out back into service without Division <br />approval. Upon learning of this reconstruction the Division requested that a <br />professional certification of the pond be provided by the operator. After <br />repeated requests the operator fai]ed to provide the certification and a <br />Notice of Violation was issued. <br />
