BANTA, Director <br />DATE: March 7, 1989 <br />T0: I.1i ke Lonq <br />FROM: Tonv Waldron \ ~J <br />RE: Pattern of Violations at the New Elk Mine (C-81-012) and the Golden <br />Eagle Mine (C-81-013) <br />This memo is a review of events since Januarv 1988 at the New Elk and Golden <br />Eagle Mines, which indicate that a Pattern of Violations may exist at both <br />mine sites. The violations were issued at the New Elk Mine between April 1988 <br />and Februarv 1989 and at the Golden Eagle 1.1ine between Januarv 1988 and <br />June 1988. <br />New Elk Mine C-81-012 <br />Within the oast twelve months, four violations have been issued at the New Elk <br />Mine. Three of these violations have been through the assessment and hearing <br />process. The violations were abated and penalties paid in each case. The <br />fourth violation was issued on Februarv 22, 1989 and is pre sently going <br />through the assessment process. The following list is a short sumnarv of the <br />violations followed by consideration of circumstances suggesting that a <br />pattern of violations may exist. <br />There were two Notices of Violation and two Cessation Orders issued to the IJew <br />Elk l+line from April 1988 to Februarv 1989. <br />C-88-031 was a Cessation Order issued on April 28, 1988 and written for <br />failure to have a permit for an area where surface coal mining and reclamation <br />operations had been conducted. Specifically, ditch D-27 and containment area <br />No. 2 along with the outlet of culvert-27 were installed outside of the <br />approved permit area. <br />Abated - 8/8/88 (Via TR-4) <br />Final Assessment - E1, 750.00, Paid <br />C-88-040 was a Cessation Order issued on August 5, 1988 and written for <br />failure to maintain a support facility to control and minimize diminution or <br />degradation of water quality or quantity. Specifically, an underground <br />pipeline which was used to convey diesel fuel was determined to be leaking. <br />The leaking fuel migrated to an abandoned pedestrian walkway and from there <br />towards the Purgatoire River where an undetermined amount of fuel seeped into <br />the river, <br />215 Centennial Building, 1313 Sherman Street Denver, Colorado 8D203-2273 Tel.
