<br />Proposed Decision <br />Pursuant to CRS 34-33-125(9), the Colorado Mined Land Reclamation Division <br />proposes to approve, in full, the request for bond release at the Meadows <br />No. 1 Mine. The Division is proposing to release bond amounts per the <br />following schedule and requirements. <br />Rule 3.03.1(3)(d) requires the Division to retain at a minimum, sufficient <br />bond to complete the approved reclamation plan. Pursuant to this rule, the <br />Division has reviewed the calculations presented in the 1986 Meadows bond <br />release application. These calculations indicate that E270,000.00 was being <br />held for monitoring and maintenance of the haul road and reclamation of the <br />loadout facilities. Therefore the Division now proposes to release <br />E229,300.00, retain $40,700.00 for the load out facilities and E304,388.00 for <br />the pit area. Bond to be retained shall apply only to reclamation of pit and <br />loadout facility areas. The amount to be retained is E345,088.00. <br />The Division finds, based on the findings contained in this document, that the <br />haul road is eligible for release of that money held with respect to erosion <br />control, post-mining land use issues, maintenance and monitoring. <br />SJM/scg <br />1365E <br />
