Findings of the <br />Colorado Mined Land Reclamation Division <br />for <br />The Meadows No. 1 Mine <br />Bond Release Application <br />This section contains the findings of the Division pursuant to the Ideadows <br />No. 1 Mine haul road bond release request. <br />Procedures for Seeking Release of Performance Bond (Rule 3.02.?_) <br />The Division finds that, based on the review process history, the requirements <br />for seeking release of performance bonds as per Rule 3.03.2 have been met. <br />Copies of written notices in accordance with Rule 3.02(1)(a) have been <br />submitted to the Division. Proof of publication in accordance with <br />Rule 3.02.2(1)(b) has also been submitted. A site inspection was held in <br />accordance with Rule 3.03.2(2). No requests for an informal conference as per <br />Rule 3.03.2(3) were received. <br />II, criteria and Schedule for Release of Performance Bonds - Haul Road. <br />In July, 1984 a technical revision for a haul road decommissioning plan was <br />approved with conditions. This plan included a post-mining land use of light <br />industrial. In accordance with landowner wishes the road was left in its <br />current configuration. Special attention was given to designing and <br />implementing a drainage control system which would protect the structural <br />integrity of the road, be easily maintained by the landowner yet still allow <br />use of the road by oil and timber producing activities. <br />The Division found in 1986, due to the nature of the designed structure, that <br />the three phase bond release approach does not apply to the haul road. In <br />this specific case, the Division found that bond may be released pursuant to <br />Rule 3.03.1(3)(d) when it has been determined that the decommission plan has <br />been successfully implemented and the road is functioning as designed, in <br />accordance with the approved post mining land use. <br />During the 1986 bond release procedure it was determined that the road had <br />been decommissioned as per the approved plan. In addition geotechnical <br />investigations were submitted which demonstrated that the road was stable and <br />had not reactivated any historical slides. At this time it is apparent that <br />the road remains in a stable configuration. One of the concerns of the <br />landowner relates to the surficial slides which existed adjacent to the road. <br />Some of these slides appear to be related to subsidence of underground <br />workings within the abandoned Trout Greek mine. Others are related to haul <br />road construction. Sun Coal Company took measures to stabilize these slide <br />areas in the past and since no additional movement has been noted, the <br />Division finds that the stabilization efforts have been successful. <br />
