BANTA, Director <br />August 9, 1989 <br />T0: Mike Long and "fom Gillis <br />FROM: Mike Savage ~~ <br />RE: Telephone conversation with Greg Lewicki about Fruits (C-81-015) <br />This morning I had a conversation with Greg Lewicki about the situation at the <br />Fruits #1 8 2 Mines. Greg told me th at he had been contracted by American <br />Shield Coal through Gregg Fernette to write a reclamation plan for the Fruits <br />#1 8 2 Mine. He had been paid an advance of 55000. He recognized that the <br />due date for the submittal of the plan is August 15, 1989, and he was asking <br />if we could provide him with an extension. <br />MY response to Greg was that he did not legally represent American Shield Coal <br />Company in this matter as he was not listed as a representative in the permit <br />application. Further, as the Division has not been contacted by American <br />Shield regarding their plans for the mine site to date, I had no verification <br />that he was indeed authorized to do work for them, and I was not in the <br />position to grant an extension without some preliminary discussions with <br />representatives of the company. <br />He asked if a letter from the company representatives in Dallas authorizing <br />him to do work would suffice. I said no. At this point, I told him, the <br />Division needed some serious commitments from American Shield and a specific <br />timetable for reclamation, possibly including a legal agreement (addressing <br />the performance of reclamation) and possibly an appearance before the Board <br />before the Division would consider extending the deadlines we have imposed. I <br />told Greg that American Shield had been less than responsive to Division <br />concerns and that we were not prepared to wait any longer for reclamation. <br />In closing, I told Greg that the Division would need some direct contact from <br />American Shield, specifically a listed representative, and that they would <br />need to have some specific proposals regarding reclamation at the site and <br />some good reasons for needing an extension. <br />Greg told me that he would ask Gregg Fernette to call me to discuss the <br />situation, though he realized Gregg was not an authorized representative any <br />longer, he would be able to explain the Division's concerns to the right <br />people at American Shield. <br />8769E <br />215 Centennial Building, 1313 Sherman Street Denver, Colorado 80203-2273 Tel.
