The West Elk Mine does not propose any stream channel <br /> diversions; therefore, this section is not applicable. <br /> D. Sedimentation Ponds <br /> 1 . Mountain Coal Company has constructed six sediment ponds <br /> (MB-1 through MB-6) and one freshwater pond (FW-1 ) . The <br /> ponds have been designed, constructed and maintained in <br /> accordance with the requirements of 4.05.6 and 4.05.9. The <br /> location of these ponds can be found on Map 54. The ponds <br /> are located as near as practical to the disturbed area and <br /> are not located within perennial streams according to <br /> 4.05.60 )(6) . <br /> E. Acid-forming and Toxic-forming Spoil <br /> 1 . Underground development waste from underground workings at <br /> the West Elk Mine is handled as coal mine waste and placed on <br /> the Lower Refuse Disposal Area. No acid-forming or <br /> toxic-forming materials are present in the spoil in <br /> quantities significant enough to affect ground water <br /> quality. Therefore, special handling is not required for <br /> these materials (4.05.8(3)) . <br /> F. Impoundments <br /> 1 . Refer to the section regarding sediment ponds (4.05.9) . <br /> G. Surface and Ground Water Monitoring <br /> 1 . The applicant will conduct monitoring of ground water in a <br /> manner approved by the Division. The ground water monitoring <br /> plan is specified in Section 2.05.4, Ground Water Monitoring, <br /> page 2.05-61 , contained in Volume 1 of the permit application <br /> (4.05. 13( 1 )) . <br /> 2. The applicant will conduct monitoring of surface water in a <br /> manner approved by the Division. The monitoring plan is <br /> specified in Section 2.05.4, Surface Water Monitoring, <br /> page 2.05-57, contained in Volume 1 of the permit application <br /> (4.05. 13(2)) . <br /> H. Transfer of Wells <br /> 1 . No transfer of wells is proposed at this time. All <br /> monitoring wells will be reclaimed prior to bond release <br /> (4.05. 14 (3)) . <br /> _29- <br />
