~i
No spoil springs exist at this former surface mine site. Any runoff that would fill the pond would
be as the result of storm water runoff from rainfall or snowmelt. There is no evidence or reason
to believe that water which would accumulate in the pond would not be suitable for stock
watering purposes. Due to the very small permanent storage capacity of this pond (less than I.5
acre-ft) and the existing dewatering tube, the State Engineer's approval is not necessary.
Therefore, as a result of this midterm review, Stipulation No. 8 was terminated.
Stipulation No. 9 was complied with by the operator since Permit Renewal #1 in May 1997. The
stipulation was originally issued as stated below;
Stipulation No. 9:
BY AUGUST 15, 1997, THE PERMITTEE SHALL SUBMIT A DESCRIPTION OF
METHODS THAT WILL BE USED TO DEMONSTRATE REVEGETATION SUCCESS FOR
COVER, PRODUCTION, AND WOODY PLANT DENSITY AS REQUIRED BY RULE
4.15.7(1) AND (2).
On August 12, 1997 the operator submitted a technical revision to the permit to revise the
revegetation standazds at the Rimrock mine. This revision was approved October 31, 1997.
Therefore, this stipulation is no longer active.
Section IV
Enforcement Actions
This section is a review of the enforcement actions issued since the last permit renewal (RN-
O1) in May 1997.
