Stipulation 30 was attached to the PR-3 proposed decision, issued May 1, 2003. The stipulation required <br />sample-based-demonstration of-soil strength properties-for foundatior} and construction soils associated with <br />Pond 016A, prior to initiation of pond construction. Adequate site specific soil strength documentation was <br />submitted to the Division in a letter of June 20, 2003. The Division notified SCC that Stipulation 30 had been <br />satisfied, in a letter of July 3, 2003. The stipulation has been resolved and terminated. <br />Stipulation 31 was attached to the TR-42 proposed decision, issued 10/14/03. The stipulatidn required submittal <br />of a complete revision application containing an appropriately amended F,thibit 13-2A, accurately depicting the <br />location of specified light use roads by November 28, 2003. The stipulation was satisfied by submittal of TR-45, <br />which was deemed complete on December 1, 2003. The stipulation has been resolved and terminated. <br />Stipulation 32 was attached to the TR-42 proposed decision, issued 10I14I03. The stipulation required submittal <br />of a complete revision application containing applicable demonstration of compliance for permanent road <br />retention including signed landowner requests for roads or road segments to be retained for the postmining land <br />use. The demonstration is to be submitted to and approved by the Division prior to approval of Phase 1 Bond <br />Release for any reclamation parcel that includes a permanent road or road segment. The stipulation remains <br />in effect. <br />Stipulation 33 was attached to the TR-42 proposed decision, issued 10/14/03. The stipulation required submittal <br />of a complete revision application containing a relevant showing statement in lieu of certification for the Coal <br />Carrier's Access Road. The stipulation was satisfied by submittal of TR~5, which was deemed complete on <br />December 1, 2003. The stipulation has been resolved and terminated. <br />All stipulations that originated prior to approval of Permit Renewal No. 3 have been fully resolved, and <br />are no longer attached to the pernit. <br />The Review Process (PRA) <br />Please refer to Findings Documents of June 15, 2001 and May 2, 2003, respectively, for RN- <br />3 and PR-3 Review Process narrative. <br />On September 19, 2003, Seneca Coal Company submitted an application for Permit <br />Revision No. 4 (PR-4) for mining and reclamation activities at the Seneca II-W Mine. <br />The application was deemed complete for purposes of filing on September 29, 2003, and <br />completeness notifications were sent to Routt County Commissioners and Routt County <br />Planning Department, OSM, and BLM Craig District and Little Snake Resource Area <br />Offices. A public notice of the application was published in the Steamboat Pilot once a <br />week for four consecutive weeks beginning October 19, 2003. The only comment letter <br />received during the review was from the BLM Little Snake Field Off ce (LSFO). The <br />LSFO noted that they had reviewed the application and found that it did "conform to the <br />Mineral Leasing Act of February 20, 1920, as amended, for development, production and <br />maximum economic recovery, and to applicable regulation of 43 CFR 3480". LSFO <br />further noted that a modification to the existing Resource Recovery and Protection Plan <br />had been submitted by SCC and was approved.
