Chandler <br />1205 Western Avenue <br />Trinidad, Colorado 81082 <br />RE: Comment on Proposed Rimrock Strip Mine <br />Dear Mr. and Mrs. Chandler: <br />This is to acknowledge receipt of your letter dated September lb, 1989 in <br />regard to the proposed Rimrock Strip Mine. The Division is indeed in the <br />process of considering the application fora permit to conduct mining and <br />reclamation operations by the operator of this mine. There area number of <br />issues still to be resolved in regard to the proposed operation, and it is by <br />no means certain at this time that the application will be approved. If the <br />Division, however, does determine that the operation meets the requirements of <br />the Regulations of the Colorado Mined Land Reclamation Board for Coal Mining <br />and proposes to approve the application, public announcements will be made in <br />the Trinidad newspaper, and a copy of the written Division's Findings in <br />regard to the application will be made available locally. You may be <br />satisfied at that time that the issues you have raised have been properly <br />addressed. If not, the public announcement of the decision initiates a 30 day <br />period during which anyone adversely impacted may so notify the Division and <br />reouest a formal hearing on the decision before the Colorado Mined Land <br />Reclamation Board. If such a request is made, the Division's decision is not <br />final unless affirmed by the Board following a formal public hearing. <br />The concerns that you have in regard to the proposed operation are certainly <br />understandable, but are perhaps more properly addressed at the local level. <br />Re Dardless of the Division's decision, the Rimrock !dine cannot proceed withoa*.-- ------- <br />having county approval. You should be aware, however, that some local <br />consideration has been made. A special use permit for the mine was issued by <br />the Board of Las Animas County Cotrmissioners July 10, 1987. <br />If I may be of any further help in this matter, please contact me <br />Sincerely, <br />James C.
