MOMANA 59931-1207 TEL406-8624172 FAX 406-8624177 June 10, 1994 JUN ~ a 1994 ~' ~'i.aiq.rdi;,. :.~:;~ Steve Renner Coal Program Supervisor State of Colorado 1313 Sherman Street Room 215 Denver, CO 80203 The Board of Directors of Arness McGriffin Coal Company which is the sole owner of a certain eighty four (84) acre mine site property located in the NE 1/4 Section 21 Township 35N, Range 10W, NMPM, State of Colorado, has just been notified by one of our stockholders that the State of Colorado Coal Program has been in trespass upon the corporate property doing reclamation work. Arness McGriffin Coal Company has never given its consent to reclamation of this property nor has or had it ever been notified, as required by law that the State of Colorado was going to proceed to do reclamation upon this corporate property for any reason under any authority. Reclamation upon this mine site which is the sole access to company owned vein coal leases may be, and probably has been, extremely damaging to these properties which we have been attempting to sell for the last 18 months since the death of Sam Arness, a principal in the company. Amass McGriffin Coal Company demands that the State of Colorado immediately cease its trespass on these properties and remove all State or private personnel and equipment from the premises. Amass McGriffin Coal Company will hold the State of Colorado and its employees responsible for all damages incurred as a result of the aforesaid trespass, including loss of sale of the site and leases related thereto.
