2) It is also possible that the quality of the AVF aquifer could be <br />impacted by drainage from the existing access/haul road which <br />currently crosses the AVF. However, it is thought that the <br />potential for significant degradation due this access/haul road <br />drainage is minimal. This is due to the high probability of <br />immediate dilution within the AVF, as discussed above. <br />Furthermore, the applicant has committed to berming the <br />access/haul road which crosses the AVF in such a manner and of <br />sufficient size so as to prevent potentially poor quality <br />drainage from the road to drain onto the adjacent AVF. These <br />berms will be constructed as soon after permit issuance as <br />practicable and prior to removing coal from the site. <br />The berms along the access/haul road, as well as the approved sediment control <br />System for the mine facilities area, will minimize the potential impacts to <br />the AVF. Furthermore, an analysis of data collected from the alluvial <br />monitoring well installed below the National King Coal, Inc., site indicates <br />that these measures are indeed sufficient to minimize impacts to the AVF. <br />Therefore, the Division makes the following findings: <br />Pursuant to Rule 2.06.8(5)(a)(i)(A)(1), the proposed operation <br />will not interrupt, discontinue or preclude farming on the <br />Alluvial Yalley Floor; <br />Pursuant to Rule 2.06.8(5)(i)(A)(II), the proposed operation will <br />not materially damage the quantity or quality of the surface or <br />ground water systems which supply the Alluvial Valley Floor; <br />Pursuant to Ruie 4.24.2(1), the proposed operation wi71 be <br />conducted to preserve, throughout the mining and reclamation <br />process, the essential hydrologic functions of the Alluvial <br />Yalley Floor both within and outside the affected area as <br />described in the permit application; and, <br />4. Pursuant to Rule 4.24.5, an environmental monitoring system is to <br />be installed, maintained and monitored so as to ensure that the <br />essential hydrologic functions and agricultural utility of the <br />AVF are not impacted. <br />The applicant is in compliance with the requirements of this section. <br />IX. Assessment of Probable Hydrological Consequences of tdinin and <br />Cumu ative Hydro ogic Impacts - Ru es 2. and 2. 2 c). <br />A. Probable Hydrologic Consequences <br />The probable hydrologic consequences section of this findings <br />document addresses the effects that the Blue Flame Coal Mine will <br />have on the ground and surface water systems within and adjacent to <br />the proposed mine area. The information used in this assessment is <br />found in Sections 2.04 and 2.05 of the permit application. <br />_1 P_ <br />
