Proposed Decision <br /> The Colorado Division of Minerals and Geology proposes to approve with stipulations an application for a <br /> permit renewal (RN-03). The renewal application was submitted to the Division on July 7, 1997, and <br /> deemed administratively complete on July 17, 1997. The application was submitted by Powderhom Coal <br /> Company for the Roadside North and South Portal Mines (formerly Roadside and Cameo Mines). This <br /> decision is based on a finding that the operation will comply with all requirements of the Colorado State <br /> Program as found in the Colorado Surface Coal Mining Reclamation Act, C.R.S. 34-33-101 et seq., and the <br /> Regulations promulgated pursuant to the Act. If no request for a formal hearing is made within thirty(30)days <br /> of the first publication of the issuance of this proposed decision, then this decision becomes final. The <br /> applicant currently has an acceptable surety for S2,903,016.00. Stipulations 2, 7, and 15 through 22 <br /> were attached to the previous approval decision. Stipulations 2 and 22 remain in effect, and are <br /> attached to this proposed decision. Stipulations 7, and 15 through 21 were resolved based on <br /> information submitted during the course of the renewal review. One new stipulation,#23, is attached <br /> to this renewal decision (RN-03). The permit application,all supporting documentation and any stipulations <br /> or conditions will become a binding part of the permit. <br /> The following stipulations are proposed for the revised permit. Stipulation Nos. 2, and 22 were incorporated <br /> through previous permitting actions,and are retained here. <br /> STIPULATION NO. 2 <br /> THE PERMITTEE SHALL SUBMIT TO THE DIVISION AN ANNUAL REPORT OF INFLOWS, <br /> DISCHARGES AND CONSUMPTION OF WATER WITHIN THE MINE. THIS REPORT IS TO <br /> INCLUDE A MINE WORKINGS MAP SHOWING THE LOCATION AND QUANTITY OF <br /> INFLOWS; A TABLE KEYED TO THE MINED MAP WHICH SHALL CONTAIN THE SOURCE <br /> (I.E., FAULTS, FRACTURES, ETC.), QUANTITY, DURATION, AND QUALITY (pH, <br /> ELECTRICAL CONDUCTIVITY, AND TEMPERATURE) OF ALL INFLOWS; A TABLE <br /> CONTAINING RECORDS OF WATER DISCHARGED FROM THE MINE, CONSUMED IN THE <br /> MINE AND IMPORTED FOR USE WITHIN THE MINE;AND A DISCUSSION OF THE WATER <br /> BALANCE IN THE MINE. <br /> STIPULATION NO. 22 <br /> AT LEAST 120 DAYS PRIOR TO INITIATION OF COAL EXTRACTION WHICH COULD <br /> POTENTIALLY CAUSE SUBSIDENCE DAMAGE TO THE 345 KV RIFLE-SAN JUAN <br /> POWERLINE,THE PERMIT-FEE WILL SUBMIT WRITTEN STATEMENTS FROM THE OWNERS <br /> OF THE POWERLINE WHICH INDICATE THAT POTENTIAL WORST CASE SUBSIDENCE <br /> DAMAGE TO THE POWER LINE COULD BE REPAIRED WITHOUT DISRUPTION OF SERVICE. <br /> NO MINING WHICH COULD AFFECT THE POWERLINE BASED ON PROJECTED <br /> SUBSIDENCE ANGLE OF DRAW SHALL OCCUR PRIOR TO DMG'S WRITTEN NOTICE OF <br /> COMPLIANCE WITH THIS STIPULATION. <br /> 2 <br />
