Recommendation <br />I recommend termination of Federal permit CO-031, issued on October 15,° <br />1982, for the Henry and Opal Weaver Ohio Creek No. 2 mine. My <br />recommendation is based on the ezistence of the Colorado cooperative <br />agreement which provides for the delegation to the Colorado Mined Land <br />Reclamation Division (CMI.RD) of the permitting responsibilities for <br />operations on Federal lands pursuant to Section 523 of SMCRA; the <br />issuance of the Colorado State permit CO-80-002; incorporation of all <br />necessary Federal permit conditions in the State permit; and review of <br />the mining plan approved on March 2, 1982. for Federal lease, C-069942. <br />The applicable conditions of the ezisting approval of the mining plan, <br />which were previously incorporated in the Federal permit, are appended <br />to this memorandum ea Attachment A. <br />The termination of the Federal permit is being done in conjunction with <br />the renewal of the Colorado State permit. Colorado MLRD has reviewed <br />the permit application package (PAP) under the Colorado State program, <br />the Federal lands program (30 CFR Chapter VII, Subchapter D) sad the <br />Colorado coogerative agreement (30 CFR 906.30) and has issued Colorado <br />permit CO-80-002 xhich authorizee surface coal mining and reclamation <br />operations on Federal and non-Federal lands in the permit area pursuant <br />to the State programrand cooperative agreement. A copy of the bond in <br />the amount of $36,000, payable to the United States and the State of <br />Colorado, is on file with OSMRE. <br />This permit termination is categorically excluded from the National <br />Environmental Policy Act (NEPA) process because the Federal permit and <br />mining plan approval rare previously covered by the NEPA process (i.e., <br />OSMRE's Environmental Assessment and Finding of No Significant Impact <br />dated Map 27, 1987)• <br />
