Dudash, Joe
From: Dudash, Joe
Sent: Wednesday, February 01, 2006 4:25 PM
To: William Bear (E-mail); Basil Bear (E-mail)
Cc: Jim Stover (E-mail)
Subject: Revised Rules
As you know, the Division sent out a letter dated December 1, 2005 that discussed the new and
revised rules that became effective November 30, 2005. There are two items in that letter that I need
to mention or emphasize. You may already be working on this anyway.
Item no. 1 of the letter refers to revised Rule 2.04.13(1)(e). Annual reclamation reports submitted
after November 30, 2005, need to have the seed tags, invoices or other comparable documentation
for any reclamation done in that year. To emphasize, this applies to any revegetation, whether it is for
final reclamation or interim stabilization, including topsoil stockpiles.
In item no. 3 of the letter, new Rule 4.15.1 {5) requires certain specific information be included in the
weed management plan. If not already in the approved plan, a revised plan needs to be submitted by
March 1, 2006. Rule 4.15.1(5) requires, in part, that there be a specific listing of the noxious weeds
in question and the procedures for managing each of the weed species. The Division is requesting all
operators to develop the revised weed management plan in consultation with the appropriate county
Noxious Weed Program.
I looked at the weed management plans in the Bowie No. 1, Bowie No. 2 and Bear No. 3 permit
applications. The Bowie No. 2 weed management plan is exactly what the Division needs so it
doesn't need to be revised. In fact, it can be a model for the other mines. The plans for the Bowie
No.1 Mine and the Bear No. 3 Mine need to be revised, however.
Further details and a contact person for the Delta County program can be found at the following
website:
http://www. ag. state. co. us/CSD/Weeds/mapping/counties/Delta. html
For Gunnison County, the website is:
http://www.ag.state.co. us/CSD/Weeds/mapping/counties/Gunnison. html
If you have any questions, please call me or Sandy Brown. Thanks!
