Box 1190 <br />Fort Collins, Colorado 80522 <br />Re: Horton Pit - File No. M-85-135 <br />Dear Ms. Spencer: <br />On January 29, 1986 we passed by the above-referenced mine location during a <br />routine inspection trip through Larimer County. The mine had obviously been <br />active for some time, however, we did not receive a Performance Warranty until <br />January 31, 1986. Technically, a mining permit does not issue until the <br />proper warranties are received in our Division and it seems that the Horton <br />Pit probably operated temporarily without a permit. I mention this only for <br />future reference, since a violation can be found when an operator proceeds <br />prior to warranty submission. <br />Also, please submit the agreement with regard to the petroleum pipeline if <br />available. I look forward to hearing from you shortly.
