Box 128 <br /> Fairplay, Colorado 80440 <br /> RE: Hulcher Aggregates, Inc. , "Fairplay Quarry", Park County, <br /> File No. M-82-086 <br /> Dear Mr. Fauvor: <br /> The Request for Transfer of Mineral Permit and Succession of Operators, <br /> Performance Warranty, Financial Warranty, and the administrative portion of an <br /> Application For A Permit was received by the Division of April 29, 1985. <br /> After reviewing File No. M-82-086, there appears to be a discrepancy between <br /> the original permitted acreage (144 acres) and the acreage listed on the <br /> Application for a Permit you have submitted (217 acres) the legal description <br /> details 217 acres, yet only 144 were actually permitted. Furthermore, upon <br /> examining Map C, it appears that a total of 102 acres will be affected. <br /> The completion of the Succession of Operator process requires that the permit <br /> be transferred as is, with amendments or changes approved at a later date. <br /> Please contact the Division regarding the acreage difference, stating that 144 <br /> acres, and not 217 acres should appear on the submitted Application For A <br /> Permit. I will change the acreage on the applications if this meets with your <br /> approval . <br /> Also, Page 3 of the Performance Warranty was notarized by Ruby J. Richard, <br /> acknowledging the signatures of both Mel W. Fauvor and Richard H. Stewart, yet <br /> Richard H. Stewart's signature did not appear. <br /> Enclosed is a Performance Warranty form. Please complete this form having the <br /> proper signatures notarized. This complete Performance Warranty form will <br /> replace the incomplete form we presently hold. Please address the replacement <br /> of the new Performance Warranty for the old in a cover letter enclosed with <br /> this submittal . <br /> Please respond to this letter at your earliest convenience, preferably prior <br /> to May 15, 1985.
