•~ 3) On October 25, 1984, the Board ordered as follows: <br />a) The hearing is closed, the Board will withold declaration of bond <br />forfeiture. <br />b) G.E.C. Minerals, Inc. shall reclaim the G.E.C. strip mine in <br />accordance with the approved reclamation plan and timetable as <br />included in the October 25, 1984 Order of the Board. <br />c) G.E.C. Minerals, Inc. shall maintain the mine site in compliance <br />with C.R.S. 34-33-120 and Rule 4 of the Regulations for coal mining. <br />d) G.E.C. Minerals, Inc. shall submit reclamation reports describing <br />the reclamation progress. These shall be weekly except during the <br />winter months (December through March), when they shall be <br />bi-monthly. <br />e) G.E.C. Minerals, Inc., shall not extract coal during the <br />reclamation activities. <br />f) Bond forfeiture proceeding will be promptly initiated if G.E.C. <br />Minerals, Inc. fails to follow the above listed criteria. <br />4) G.E.C. Minerals, Inc. is not adequately bonded at this time. <br />5) G.E.C. Minerals, has failed to reclaim in accordance with the approved <br />reclamation timetable. <br />6) G.F.C. Minerals, Inc. does not have the financial resources to continue <br />reclamation at this site. <br />CONCLUSIONS OF LAW <br />1) G.E.C. Minerals, Inc. has failed to comply with the October 25, 1984 <br />Board order. <br />2) In accordance with C.R.S. Section 34-33-124(4) and Rule 3.04.1 the <br />reclamation bonds for the G.E.C. strip mine are to be forfeited, <br />
