D. Sedimentation Ponds <br />Disturbed areas in the Elk Creek yard are treated by two sediment ponds, Ponds <br />A and B. The Hubbard Creek Pond controls sediment from the Upper Hubbard <br />Creek facilities area, and the East Yard Pond controls sediment from the east <br />yard of the Elk Creek facilities yard. One additional pond is approved for <br />treatment of underground discharge from the Sanborn Creek portals. Specific <br />plans are found within Appendix B of the permit document. All ponds are <br />designed in compliance with Rule 4.05.6. <br />E. Acid-forming and Toxic-forming Spoil <br />There is no evidence of acid- or toxic-forming material at this site. <br />F. Impoundments <br />Refer to Section D, Sedimentation Ponds, above. <br />G. Surface and Ground Water Monitoring <br />The applicant will conduct monitoring of ground water in a manner approved <br />by the Division. The ground water monitoring plan is specified on Page <br />2.05-46iii of the permit document (4.05.13(1)). <br />The applicant will conduct monitoring of surface water in a manner approved <br />by the Division. The monitoring plan was submitted under 2.05.6(3)(b)(iv) and <br />as specified on page 2.05-46iii of the permit document (4.05.13(2)). <br />I. Discharge of Water into an Underground Mine <br />Discharge of water to underground workings will not occur. <br />Stream Buffer Zones <br />The Division has approved surface and underground mining activities within <br />100 feet or through perennial streams. This decision was based on a finding that <br />on Hubbard Creek the original stream channel will be restored, water quality <br />and quantity shall not be adversely affected, and appropriate riparian vegetation <br />will be reestablished. On the North Fork of the Gunnison, the decision was <br />based on the fact that the original stream channel would not be affected and <br />water quality and quantity would not be adversely affected. The buffer zone <br />variance was granted for the areas located at the stream crossing and pre-law <br />18 <br />
