Initial discovery and inspection of the site: April 23, 1980. <br />Records indicated the operation was unpermitted. <br />Due to an increasingly burdened May Board agenda, enforcement action <br />was deferred to the June Board meeting. <br />2. May 30, 1980, staff contacted about the above operation by Mr. Slovek's <br />brother-in-law, George Hurd. Mr. Hurd phoned in a complaint on behalf <br />of Mr. Slovek. <br />3. June 2, 1980, staff, in response to the May 30th complaint, met with <br />the complaintants on site, and filed a detailed inspection report that <br />day. <br />4. June 5, 1980, staff notified the County of the possible violation, the <br />resulting Board meeting to consider action under Section 34-32-123, <br />1973, CRS, and the nature of enforcement action which could occur. <br />5. June 6, 1980, David C. Shelton, (MLR Director), submits memo to file <br />summarizing the situation at that time. The Memo indicates direct <br />contact describing MLR concerns over the phone to Weld County officials <br />and the County Attorney by Lew Woods (MLR Assistant Attorney General) <br />and David Shelton. <br />6. June 9, 1980, Sunshine notice posted for Special Board meeting regarding <br />the above site, to occur on June 10, 1980. <br />7. June 10, 1980, Special Board meeting to consider action under Section <br />34-32-123, CRS 1973. Mr. Slovek presented testimony in objection to <br />the operation at that time. Results of that meeting: <br />a. Weld County found in violation of mining without a permit; <br />b. Weld County found in violation of operating against a Cease <br />
