A HISTORY OF APPLICANTS PAST COMPLIANCE <br />A check was made concerning the applicant's past compliance with national and state coal <br />reclamation rules and regulations using the national Applicant Violator System (AVS). <br />Checks were made on the following dates, with the following findings issued: <br />Date of AVS Check <br />01-21-1993 <br />01-25-1993 <br />04-07-1993 <br />04-09-1993 <br />OSMRE Recommendation <br />Issue <br />Issue <br />Conditional Issue <br />Conditional Issue <br />A final check using the Applicant Violator System will be made prior to issuance of the <br />permit. <br />On April 7, 1993, a recommendation came from OSMRE to condition the issuance of the <br />applicant's permit due to a cessation order given to a mine controlled by the applicant in <br />the State of Kentucky. Therefore a stipulation has been added to the permit. Please refer <br />to Section B, Item 7 of this document. <br />A DESCRIPTION OF THE ENVIRONMENT <br />General <br />The HG Loadout and railroad spur, which was part of the HG Coal Mine located seven <br />miles northeast of the mine site, was purchased from HG Coal Company by Hayden Gulch <br />Terminal, Inc. (HGTI). The HG Coal Mine has been reclaimed and both it and the loadout <br />were in temporary cessation until HGTI agreed to purchase the loadout from HG Coal <br />Company (with no coal being stored or shipped from the loadout since 1987). HGTI has <br />leased the loadout to Peabody Coal Company to operate. <br />The HG Loadout is located in Routt County, approximately two miles southeast of the <br />Town of Hayden, Colorado (see Figure 1). Approximately 95% of the surface acreage of <br />the proposed permit area is owned by HGTI, with the rest being leased from the State of <br />Colorado, the Town of Hayden and private individuals. No coal is proposed to be mined <br />within the proposed permit area. <br />The HG Loadout lies at approximately 6,400 feet in elevation and is situated in the bottom <br />of the Dry Creek Valley. The proposed permit area is traversed by Dry Creek, the Seneca <br />II-W Mine's Tie-Across Haul Road and Routt County Road 37. <br />a <br />
