'Ruadside Mine Reclama[ion Issues <br />November 8, 2000 <br />Page i <br />..~. <br />Mid-term Permit Review <br />The Division's mid-term review was issued August 8, 2000. A number of issues regarding final reclamation were <br />addressed in the mid-[erm letter, and appropriate revision of the permit was requested. The letter required that a <br />technical revision application addressing the identified concerns be submitted by October 8, 2000. Powderhom <br />submitted a technical revision application (TR-34) addressing a portion of one identified concern (2-Wes[ Portals and <br />South Fan reclamation sediment conaol) in eazly September 2000, and this revision application was approved by <br />DMG. Powderhor has failed to submit a revision application addressing the remaining nine compliance issues <br />identified by the Division. Items to 6e addressed include: (l) documentation of final resolution or current status of <br />certain State of Virginia and West Virginia violations; (2) sediment conaol plan for final reclamation of the North <br />Portal Coal Handling Area; (3) evaluation of the effect of seepage in the vicinity of the South Portals on final backfill <br />stability in [hat area; (4) evaluation of the need for provision of drainage pipes through the recently installed South <br />Portal seals; (5) provision of modified surFace drainage plan for reclaimed South Portal facilities area and Roadside <br />Refuse Disposal Area (RSRDA); (6) identification of an alternative soil borrow area for non-toxic refuse cover for <br />RSRDA; (7) evaluation of revegetatian success standards and possible need for remedial rcvegetation aeatmenu in <br />certain previously revegetated areas; (8) update text and maps to reflect Ute Water Conservancy District's new six <br />foot diameter steel Plateau Creek raw water pipe; and, (9) update subsidence pro[ection "Manmade Features Map" if <br />warranted. Powderhom must submit a response to [hest nine issues by November 30, 2000. <br />N closing, the Division recognizes the effort Powderhom has made to maintain on-the-ground compliance and initiate <br />reclamation in a timely manner. As you are aware, significant additional reclamation is required under the <br />reclamation schedule in the approved permit in the coming months. Because mining ceased at Roadside on December <br />2, 1999, "Year (" of the approved reclamadan schedule is to be initiated no later than December 2, 2000.
