The operator for the Bowie No. 1 Mine was changed in Minor Revision No. 99, from Bruin Mining Company to Sherpa Paonia, Inc. MR-99 was approved with conditions on January 21, 1997. Stipulation No. 52 was attached to MR-99 and approved the transfer conditional upon the continued compliance with a settlement agreement that had been linked to the operator. Stipulation No. 52 was terminated on April 25, 1997. With Technical Revision No. 28, the operator changed from Sherpa Paonia to Bowie Resources Limited. On October 17, 1997, BRL submitted an application for Permit Renewal No. 3. The Division sent three adequacy review letters during the review process. With the acceptability of the responses sent by BRL, the Division proposed a decision on December 14, 1999 to approve with stipulations the Permit Renewal No. 3 application. The proposed decision became final on January 21, 2000. Because BRL had secured the right of successive renewal, the permit renewal issuance date was back-dated to Apri120, 1998. This proposed decision and findings document is for Permit Renewal No. 4 (RN-04). On July 22, 2002, the Division sent the required notice to the applicant that a complete permit renewal application needed to be submitted by October 22, 2002. BRL submitted the renewal package on September 13, 2002. The renewal package was called complete on September 25, 2002, thereby securing BRL's right of successive renewal. Notification letters were sent out on the same day to the appropriate local, state and federal agencies, local associations and other interested parties. The public notice was published in the Delta County Independent on October 2, 9, 16 and 23, 2003. The Division sent out two adequacy review letters dated November 27, 2002 and December 26, 2002. BRL responded with a submittal dated January 23, 2003. The Division sent a third adequacy review letter on February 20, 2003. BRL's response letter, dated March 17, 2003, provided ownership and control information while BRL's response letter dated March 28, 2003 contained additional adequacy information. In a letter dated April 11, 2003, the Division sent to BRL additional questions concerning ownership and control information. Further questions were asked in the Division's next two adequacy review letters dated Apri123, 2003 and April 30, 2003. BRL submitted their final response letter dated May 15, 2003. With all questions satisfactorily answered, the Division is proposing a decision to approve with one modified stipulation (Stipulation No. 54) Permit Renewal No. 4. This document contains the "Proposed Decision to Approve With One Stipulation the Permit Application", a description of the environment affected by the mining operation and the reclamation plan, and the Division's written findings of compliance as required by the Colorado Surface Coal Mining Reclamation Act.
