Lamb, Greene & MacRae, L.L.P., the United Mine Workers of America <br />' Combined Benefit Fund and its Trustees, (collectively, the <br />"Combined Fund") on its own behalf and as successor by merger to <br />the United Mine Workers of America 1974 Benefit Plan and Trust and <br />its Trustees, defendants in this adversary proceeding, by and <br />through their counsel, Kimball, Parr, Waddoups, Brown & Gee and <br />Groom & Nordberg, Chartered, and the United Mine Workers of <br />America, by and through its counsel, Arthur F. Sandack and <br />Cornfield & Feldman, pursuant to Fed. R. Bankr. P. 7041 and Fed. R. <br />Civ. P. 41(a)(1), and based on the settlement agreement dated <br />1995, between the Combined Fund and CF&I, which <br />has been approved by Ordez of the Court entered on <br />1995, hereby stipulate to dismissal of this adversary proceeding <br />with prejudice, and for purposes and convenience of court <br />administration, move the Court for an Order dismissing this <br />adversary proceeding with prejudice.
