Date by which Motions for Reconsideration Must be Filed, and (4) <br />Setting Hearing on Motion for Reconsideration, If Any Are Filed, <br />and (B) on January 20, 1993 entered its Order Denying Motion <br />(Dated 1/11/93) of the Bituminous Operators Association, inc. for <br />Reconsideration of the Court's December 17, 1992 Order Fixing <br />January 25, 1993 as the Bar Date (collectively these two Orders <br />will be referred to as the "Bar Date Order"); and <br />WHEREAS, on January 25, 1993, the Combined Fund and the <br />1992 Plan each timely filed in each of the ten CF&I chapter 11 <br />cases pleadings styled as statements in lieu of proofs of claim <br />or, in the alternative proofs of claim (collectively, the <br />"Claims") in which the Combined Fund asserted a claim of $20 <br />million and in which the 1992 Benefit Plan asserted a claim of <br />$30 million; and <br />WHEREAS, CF&I filed objections to the Claims (the "Claim <br />Objections") on a variety of bases, including that the Claims <br />were not entitled to priority; and <br />WHEREAS, the Bankruptcy Court issued its Order dated <br />February 19, 1993 Estimating the Claims of UMWA Combined Benefit <br />Fund and of 1992 UMWA Benefit Plan Pursuant to Motions dated <br />January 26, 1993 (the "Estimation Order"), in which the <br />Bankruptcy Court estimated the priority claims of the Combined <br />Fund and the 1992 Plan at S0; and <br />WHEREAS, the Claim Objections, other than the issue as to <br />the priority of the Claims, remain pending before the Bankruptcy <br />Court; and <br />WHEREAS, the Bankruptcy Court on February 12, 1993 entered <br />its Order Confirming Debtors' and Railroad Trustee's First <br />3 <br />
