MAR 15 2004 ~ <br />Southfield mine post office box 459 florence, coloratlo 61226 (719) 784-6395 GIYISIM o(Minera)s and Geel6gy <br />Mr. Jim Stark -Reclamation Specialist Mazch 8, 2004 „' . <br />Colorado Division of Minerals and Geology , <br />1313 Sherman Street -Room 215 <br />Denver, CO 80203 <br />RE: RAIL LOADOUT SITE - SOITfHFIELD MINE -Permit No. C-81-014 <br />Energy Fuels Coal, Inc. -Fremont County, Colorado <br />Dear Mr. Stark: <br />This letter is to advise that a gravel pit/crushing operation adjacent to the Energy Fuels <br />Coal, Inc (EFCI) East Loadout site, located 1.5 miles west of Florence, Colorado, has removed <br />soil and material from within the EFCI Reclamation Permit Boundary of the Loadout site. As you <br />are aware, EFCI received a Phase 1 Partial Bond Release for the Loadout site in 1997. Seeding <br />operations on the Loadout area were done in the fall of 1997. The area of concern disturbed by <br />the gavel pit operation is located south of the railroad tracks - -that area south of the tracks had <br />not been re-seeded as was the rest of the Loadout site during 1999. Therefore, the area now <br />disturbed has entered the seventh yeaz of the ten year reclamation liability period. <br />The operator of the gavel pit is Fremont Paving, LLC of Canon City, Colorado. The <br />gavel pit is located adjacent to EFCI's south permit boundary of the East Loadout {east of <br />County Road 79). The area currently disturbed spans approximately 750 feet east along the <br />railroad tracks and south from the tracks to the south permit boundary. Further, due to <br />excavation, the topogaphy has been changed effecting the AOC and possibly the current drainage <br />control plan. <br />I first contacted Fremont Paving on December 2, 2003 and was referred to "Denise" as <br />the contact. Following that date, I made numerous attempts of contact for Deruse and received a <br />Few responses. Given that Denise had mentioned the property description she had was not very <br />detailed, I went to the County Recorder on 01-31-04 and got copies of the railroad property deed <br />and the assessors map used for taxation. On 02-04-04 I hand delivered copies of the deed and <br />map plus copies of maps from the EFCI files to Fremont Paving's office. By phone (02-04-04), <br />--nenise~i~he~so?,ald.meet with her management-to.discuss-the-deed-and-.maps: mater,-02-.IO-04, -- <br />Denise said there had been delays to their in-house meetings and she didn't have any more <br />information for me at that time - -meanwhile, Fremont Paving continued the disturbance within <br />EFCI's approved south disturbance boundary. <br />Thank you for contacting the Minerais Division in regards to this concern.
