<br />removal of miscellaneous debris at the Rienau # 2 mine site as a prerequisite to final bond release at <br />the August 14, 1997 inspection, by letter of 21 August 1997 (Document 30) and the 10 September <br />1997, 23 October 1997, 19 November 1997, and 19 December 1997 inspections. A letter from Mr. <br />Rienau (December 9, 1997, Document 31) relieves the Applicant of this policing action by requesting <br />retention of the items at their present locations. On January 5, 1998, the Division received a telephone <br />call from the Applicant that all mine identification signs at the sites had been removed. <br />17. Summary and Conclusions <br />Based upon a review of the mine permit, the applicant's bond release application, and site inspections, <br />the Division finds that Enron Coal Company has successfully completed all surface coal mining <br />reclamation operations in accordance with the approved reclamation plan and met all requirements of <br />the Act and the Rules for total Phase III Bond Release. <br />IV. PROPOSED DECISION <br />Based on this Findings of Compliance, the Division proposes to approve Enron Coal Company's <br />Application for a Partial Phase II/ III (total and fmal) bond release for the Meeker Area Mines (Permit <br />C-81-032). All requirements of the Rules and Act have been successfully completed and the Division <br />has made a proposed decision to release the performance bond fully. This proposed decision will <br />release the applicant from liability for additional reclamation work at the site. Should the Proposed <br />Decision become final, the Division will cease Permit (C-81-032) jurisdiction. <br />3 0 20 January 1998 <br />
