B. Rule 3.03.2(2) Inspection and Evaluation by the Division <br />1. Rule 3.03.2(2) Inspection and Evaluation <br />The Division shall conduct an inspection and evaluation of the reclamation work involved. The surface <br />owner and agent or lessee, if any, shall be given reasonable notice of such inspection, and may <br />participate with the Division in making the inspection. <br />The Division scheduled and conducted a bond release inspection on August 14, 1997. The site <br />inspection was conducted in compliance with Rule 3.03.2(2). A list of those invited to accompany the <br />Division on [he inspection is at Document 5 (as the 1st column of the table). Document 6 is an <br />example letter sent to the invitees. <br />2. Rule 3.03.2(2) Written Results of Inspections and Evaluations <br />Written results of inspections and evaluations shall be made immediately available for public inspection <br />in the offices of the Division. The results of inspections and monitoring conducted pursuant to Rules <br />4.05.13 and 5.02 will be considered. <br />Written results of the Phase II/III inspection and evaluation were placed on file for public inspection <br />at the offices of the Division and the Meeker Counry Court House in compliance with Rule 3.03.2(2), <br />and copies of the inspection report were provided to the attendees and to Keith Whitaker, Bureau of <br />Land Management, White River Resource Area. The written results of the Phase II/III inspection and <br />reports of Division monthly partial and quarterly complete inspections (for the last three years) were <br />on file at the Division and were found on file at the Meeker County Court House during [he Division <br />inspection of December 19, 1997 (this most recent Division inspection being a complete inspection). <br />Results of inspections and monitoring were considered by the Division in this Findings of Compliance <br />pursuant [o Rules 4.05.13 and 5.02. Information on who attended, who they represented, topics of <br />concern, and other coordination is at Document 5 and addressed under Paragraphs III.C. and III.D. <br />following. <br />C. Evaluation by the Division -Phase II <br />1. Rule 3.03.1(2)(b) Eighty-five Percent Bond Release <br />Up to eighty-five percent of the applicable bond amount shall be released upon the establishment of <br />vegetation which supports the approved postmining land use and which meets the approved success <br />standard for cover, pursuant to 4.15.8, meets applicable productivity standards for prime farmlands <br />or alluvial valley floors pursuant to 3.03.1(3)(b), or croplands pursuant to 4.15.9. With the exception <br />of prime farmlands, evaluation of vegetation establishment pursuant to this paragraph is based on <br />statistically valid data collected during a single year of the liability period. Rule 3.03.1(3)(c) states, <br />"Where a silt dam is to be retained as a permanent impoundment as described in 4.05.6 or 4.05.9, <br />16 20 January 1998 <br />
