Legal description of Avalanche Canal and Syphon: <br />1) Headgate No. 1 being the initial point of <br />diversion of said Avalanche Canal and Syphon <br />is located on the right bank of the Crystal <br />River at a point whence the witness corner of <br />the SW Corner of Section 9, Township 10 South, <br />Range 88 West of the 6th P.M. bears North 3°9' <br />West 546 feet. <br />2) Headgate No. 2 being the second point of <br />diversion of said Avalanche Canal and Syphon <br />is located on the right bank of Avalanche <br />Creek at a point whence the W4 Corner of <br />Section 28, Township 9 South, Range 86 West of <br />the 6th P.M. bears North 67°15' West a <br />distance of 9,538.1 feet. <br />E. Proposed change: Applicants claim an alternate <br />point of diversion for 12.39 acre feet annually at <br />the Loesch Gravel Pit to offset evaporative <br />depletions due to the exposure of ground water. The <br />Loesch Gravel Pit is located in Sections 7 and 18, <br />Township 6 South, Range 92 west, 6th P.M. <br />F. Applicants will limit their diversion pursuant to <br />this priority to water available in priority at the <br />originally decreed points of diversion described in <br />paragraph 6D, above.
