Item 3 <br />We did place all of our drums and barrels in a concrete oil containment structure. I have also notified all of <br />our employees that they are to continue keeping any barrels in the containment structures. <br />Item 4 <br />Although 1 stated that we cut down and transported all of the Canadian Thistle to the dump, we actually <br />pulled the weeds. 1 did not submit a weed control plan at the time, so 1've enclosed one for your approval. <br />1 don't mean to make it too simplistic, but the plan is just to pull weeds if they're observed. <br />Item 5 <br />Your report mentioned a topsoil pile that I assumed was the one on the east end of the pit - the one that is <br />processed and sold. Since it is being processed, I didn't fcel that it needed to be seeded. You have since <br />clarified that it is the pile on the southwest side of the pit. We have now raked and seeded this pile and will <br />do so again th the spring. 1 apologize for the error. <br />Item 6 <br />You are absolutely correct that 1 was confined about the details surrounding Violation M-93-017 that was <br />issued in 1993. I was not working for Telluride Gravel at the time of the violation so I did not have first- <br />hand knowledge of it. Our previous General Manager, Gary Bennett, explained the violation tome. After <br />his employment was terminated in 1995, I sorted through the files but no corrective actions were listed in <br />the DMG inspection of I 1-9-94. Again, my first contact with the DMG was in December of 1997 -when <br />our site was inspected. No corrective actions were listed in that report either, so I didn't realize that any <br />DMG issues were pressing. 1 knew that there had been a Cease and Desist Order issued, but 1 thought that <br />it was all tied into the USFS trespassing issue. 1 thought that we had to cease due [o the fad that we sere <br />trespassing. Since we had actively started working with the USFS to resolve the trespazsing issue, l <br />thought that whatever they instructed us to do would be in compliance with all government agencies <br />concerned. <br />On October 5, 1994, the USFS had sent us a Bill far Collection for $566,190.00. This was for trespazsing, <br />loss of royalty, and stream rehabilitation. It was my understanding that this money was owed bepuse we <br />had inadvertently trespassed beyond our permit boundary. Rather than demanding cash, the USFS and TGI <br />worked together to come up with an equitable solution to this bill -paying cash would have put us out of <br />business. <br />The solution ended up being that we had to replace the material that was taken. The only difference is that <br />the surface will now drain back to the west so that stortnwa[er will be concentrated along the USFS/TGI <br />boundary. From here, it will discharge to the river. We also knocked down the diversion dike in the river - <br />the dike that had diverted the river away from the mining operation. !n other words, we were instructed to <br />just put material back to its original position it was in before the trespass. The USFS also informed me that <br />they would obtain all permits necessary to perform the work. Although we are not complctely done with <br />the work, the USFS formally rescinded their Bill for Collegian oo April 5, 2000. <br />If one looks at the site now and the final reclamation plan, there really isn't much difference. The <br />difference is where the eastern boundary is defined. The USFS believes that we had no right to go az far to <br />the eazt az we did. The DMG believes that we did have the right and are therefore responsible for that area. <br />Either way, the two reclamation plans show the same drainage pattern. The USFS plan just requ'ves a little <br />Flatter slope than a 3:1. 1 submitted the USFS plan to the DMG last month az part of my effort to address <br />all of the corregive actions listed in the inspection report. The only problem is that the USFS does not <br />have a plan that they drew up - 1 had to draw it. There simply is not a USFS plan available. My sketch is <br />all that exists and 1 have submitted it for DMG approval. <br />Item 7 <br />It is stated that the Division recognizes that the USFS and the Corps of Engineers did not issue permits for <br />the reclamation work performed in this area. I believe that they did. The USFS said that they obtained all <br />
