As <br />1 understand fvtr. Parley's request, he would like to remove some excess overburden fro the Alma Placer <br />permitted area and permanently place it on adjacent property owned by Ducommon Tru t, but outside of <br />the permitted area. This material would then be used to fill voids left by pre-law minin activities which <br />would assist in reclaiming these areas. The amount of material being discussed would pparently not <br />create a material balance problem for achieving final slope grades at the Alma site but ould be useful in <br />reclaiming the adjacent property. <br />Since the proposed activity clearly assists the Alma Placer site by removing excess mat rial from the <br />affected area, which apparently helps to alleviate congestion and also transports affecte area material off <br />site, the Office has determined that this action will require an amendment to the permit. However, we <br />would encourage Reclamation Resources to petition the Board for a declaratory order i they disagree with <br />this interpretation. If this is a one time only activity which will assist in reclaiming pre- aw disturbances, <br />the Board may determine that an amendment is unnecessary. It is likely that the Board vould need some <br />assurance that the area where the excess material ends up is reclaimed and done so in a imely manner. <br />Also, it would need to be clearly demonstrated that the amount of material being discus ed would not <br />negatively affect the post-mining topography at the Alma Placer by creating a material glance deficit. <br />If you would like to proceed with a Declaratory Order request, please contact me at leas 10 days prior to <br />any regularly scheduled board meeting. The next regularly scheduled meeting is April 8th and 29th, <br />1999. if you want to proceed at that meeting please subm it a written request to our offs a by no later than <br />April 18, 1999.
